Urge District Attorney Chisolm to petition the judge to withdraw the death warrant, and support clemency for Troy Davis

You may have recently heard the news: a potentially innocent man is now set to be executed in Georgia on Wednesday, September 21st. But there are still a few hours left, and I need your help to save Troy Davis’ life.

Chatham County District Attorney Larry Chisolm is the man who originally issued the death warrant against Troy Davis, and he is in a unique position to petition the judge to withdraw that death warrant against Troy.

Since Troy Davis’ conviction, the facts of the case have changed dramatically. The evidence in the Troy Davis case has always been circumstantial due to a lack of relevant physical evidence and no murder weapon. The conviction was based almost wholly on witness testimony, and seven of the nine witnesses have recanted their testimony or changed their stories.

In light of this knowledge, the evidence used to convict Troy Davis appears even weaker.

"It’s the wrong decision," said one of Davis’ attorneys, Jason Ewart. "It’s a mistake."

He said the five-member board ended its presentation after three hours while the other side — prosecutors and the MacPhail family — was given at least four hours.

It sounds like they [prosecutors and family members] just brow beat them [the board],” Ewart said.

Davis, convicted of the 1989 killing of an off-duty Savannah police officer, has steadfastly maintained his innocence. In the decades since his conviction, his case has become somewhat of a cause célèbre, with former President Jimmy Carter, Archbishop Desmond Tutu and even Pope Benedict XVI, among others, urging the courts to grant Davis a new trial. Advocacy groups rallied. Letter-writing campaigns were launched.

In 2009 Davis, by filing an original writ of habeas corpus with the U.S. Supreme Court, convinced the justices to order a federal court in Georgia to look into new evidence that he said would establish his innocence. Earlier this year the Supreme Court turned down what likely was Davis’ last set of appeals.

Some of the witnesses in the case against Davis have recanted their testimony. Even with that evidence, Judge William T. Moore Jr., the trial judge, concluded that Davis’ evidence was “largely smoke and mirrors” and ruled against a new trial.
